Customer Supplied Apparel Waiver

This agreement is required to be signed by customers who wish to supply their own blank products to Artist-Tees.com for decoration.   It simply states that we will not be responsible for replacing that product for any reason.   It’s rare, but occasionally the transfers or other decoration we attempt to apply may be defective, we may make a mistake, or the product my simply be defective from the manufacturer.   

If you purchase the blank product from Artist-Tees.com, we will, of course, be responsible for replacing damaged product for any reason (with the exception of incorrect artwork that was approved by the customer).

Customer-Supplied Apparel Waiver and Release of Liability

This Waiver and Release of Liability (“Waiver”) is entered into by the undersigned customer (“Customer”) in connection with any apparel or other garments (“Customer-Supplied Items”) provided to Artist-Tees (“Company”) for the purpose of decoration, embellishment, or customization.

1. Assumption of Risk
Customer acknowledges and agrees that providing Customer-Supplied Items for decoration is done entirely at Customer’s own risk. Customer understands that such items may be damaged, misprinted, lost, or otherwise rendered unusable during the decoration process, regardless of the cause or fault.

2. Responsibility for Replacement
Customer expressly agrees that the Company shall bear no responsibility or liability for replacing any Customer-Supplied Items for any reason whatsoever, including but not limited to:

  • Printing or production errors, regardless of whether such errors are attributable to Customer or the Company;
  • Material defects in the Customer-Supplied Items;
  • Damage, loss, or destruction occurring before, during, or after the decoration process.

Customer further agrees that the sole responsibility for providing replacement items shall rest with the Customer.

3. Company’s Discretion to Assist
Notwithstanding the foregoing, the Company may, in its sole and absolute discretion, elect to replace a Customer-Supplied Item. In such cases, the replacement shall be billed to Customer at the Company’s cost plus fifteen percent (15%), or the Company may instead require Customer to provide a replacement directly. Nothing in this Waiver obligates the Company to provide any such replacement.

4. Release of Liability
Customer hereby releases, waives, and discharges the Company, its officers, employees, contractors, and agents from any and all claims, demands, or causes of action arising out of or related to the loss of, damage to, or replacement of Customer-Supplied Items.

5. Acknowledgment
By signing below (or otherwise authorizing the use of Customer-Supplied Items), Customer affirms that they have read, understood, and voluntarily agreed to the terms of this Waiver, and acknowledges that this Waiver shall be binding upon Customer, their heirs, successors, and assigns.
